SIMPSON, CHIEF, WATER MANAGEMENT BRANCH SUBJECT: FLATIRON PAVING COMPANY - NELSON PIT, BOULDER COUNTY, APPLICATION FOR MINING AND RECLAMATION PERMIT As requested by your office, we have reviewed the application for a gravel pit near Longmont. We cannot recommend approval of the application until the applicant has provided the following additional information: 1 , Exhibit E, page E-5, states that the haul road will be treated to minimize dust problems and that processed materials will be sprayed during the crushing and con- veying of the materials. However, the report does not provide any information regarding the amount or source of the water that will be used for these mitigating meas- ures. (If the applicant plans to use pit water, which is ground water, for these mitigating measures, then the utilization of this ground water is considered a benefi- cial use which would be in violation of the 1973 Colorado Revised Statutes, 37-90-137, since the applicant does not currently have a permit to use ground water. ) 2, Exhibit G includes an analysis of the consumptive use of pasture grass in the project area using the Blaney- Criddle method.
