• Mr. Dan Allen, Surveyor. Mr. Karo and Mr. Allen ensured that all work was <br />performed in accordance with the design and the specifications. <br />Mr. John Pellicer (MWH) inspected the structure on a regular basis to <br />verify compaction and to make sure that the embankment was being <br />constructed in accordance with Rule 9, Part 4.05.6(10). Mr. Roy Karo <br />(Seneca) and/or Mr. Jay James (formally with MWH) were also on the site at <br />several critical occasions during the construction of this pond. The <br />summary of the compaction testing for the Pond Olla embankment is located <br />in Addendum 13-19-E. <br />The purpose of my inspection and certification was to make sure proper <br />construction of Sedimentation Pond Olla and to satisfy the requirements of <br />Rule 9.05.6(10) of the Colorado Mined Land Reclamation Board. The material <br />was placed in the embankment to meet or exceed the design specifications <br />(see Addendum 13-19-E for compaction information). This as-built report <br />confirms the construction of this structure meets or exceeds the Rules and <br />Regulations of the Colorado Mined Land Reclamation Board. The structure is <br />stable, and displays no evidence or indications of slope instability. <br />To the best of my knowledge, based on my professional expertise, and to the <br />extent possible, Pond Olla at the Yoast Mine was constructed in accordance <br />with the prudent state-of-the-art methods for earthen embankment <br />construction. Further, the structure was constructed in compliance with <br />the approved design, to the extent possible, as specified in Attachment 13- <br />12, Drainage and Sediment Control Plan, of Seneca Coal Company's approved <br />mine permit. <br />Conclusion <br />Sedimentation Pond Olla does meet or exceed the design and performance <br />requirements of the Colorado Mined Land Reclamation Board. Seneca Coal <br />Company will inspect the pond quarterly to evaluate structural integrity, <br />storage capacity conditions and remedial work requirements in accordance <br />with the approved mine permit. Therefore, pursuant to Rule 9.05.6(10), the <br />above is the Sedimentation Pond Olla as-built certification report. <br />• <br />TR-27 3 Revised 09/09 <br />
