I• <br />B) On the mining plan map, there are six circulaz symbols not identified in the legend. Wha[ do <br />these symbols represent ? On the same map, the phased acreage adds up to 567 acres. Please <br />refer to the question on the Legal Description. <br />C) Under 6.4.4 (C), the operator states, "No water impoundments are planned at this time, <br />however, if water for processing would become available, at a future date, all the needed water <br />system and controls would be engineered for this site, which may include a settling pond". The <br />placement of such a structure might require a submittal of a technical revision prior to placement. <br />Please contact the Division if and when the operator decides to place the structure with in the <br />permit area. <br />D) Under 6.4.4 (d) and (e), the operator states,"The azea disturbed will not exceed 35 acres at <br />any time, including haul roads and processing areas. It is proposed to use a floating bond on 35 <br />acres". Please note that until a request fora release is submitted and approved by the Division, for <br />the reclaimed acres, the maximum disturbance at any given time can not exceed 35 acres. <br />V) EXHIBIT "E"6.4.5 Reclamation plan <br />A) Under 3.1.5 (7), the operator states, "Where the pit does not daylight, back slopes during <br />mining will be completed at a slope 3H:1 V or flatter". What would be the maximum anticipated <br />slope be if the pit daylights, please explain. <br />VI) EXHIBIT "F' 6.4.6 Reclamation plan map <br />Adequate <br />VIn EXHIBIT "G" 6.4.7 Water Information <br />A) The pre-mining plan map submitted with the application shows a portion of a small Gulch, <br />that appeazs to feed into the Rocky Ford High line Canal, to be with in the azea to be mined. How <br />would the proposed mining and changes to the over all topography (post mining) affect the <br />Rocky Ford High line Canal ?Please explain. <br />VIII) EXHIBIT "H" 6.4.8 Wild Life Information <br />A) Under Rule 6.4.8 (1) (a), the operator is required to describe the significant wildlife resources <br />on the affected land, (b) seasonal use of the azea, ©the presence and estimated population of <br />threatened or endangered species from either federal or state lists, (d) A description of the general <br />effect during and after the proposed operation on the existing wildlife of the azea, including but <br />not limited to temporary and permanent loss of food and habitat, interference with migratory <br />routes ,and the general effect on the wildlife from increased human activity, including noise. <br />Please provide the required information in accordance with the above Rule. The fact that the post <br />mining land use is rangeland not wildlife habitat as stated by the operator does not exclude from <br />providing the required information. <br />IX) EXHIBITS "P',"J" and "K" -6.4.9-11, Soils, Vegetation and Climate Information, Adequate <br />
