Alternatively, an automatic appro~ral will Occur where the Division fails to <br />notify the applicant/operator that the appllt:ation has been dented. This decision must <br />be made thirty (30) calendar days from the date the application was submitted. However, <br />the performance and financial warranties must be submitted and approved by the Division <br />before the permit viii be issued even if you receive an automatic approval. NO MINING <br />OPERATIONS SHALL BEGIN UNTIL A PERMIT IS ISSUED (Rule 7.2<2)). <br />It shall be a provision of this permit that the operations will be conducted in <br />accordance with the terms and conditions listed to your application, as real as rith the <br />provisions of the Act and the Mineral Rules avid Regulations to effect at the time the <br />permit is issued. <br />Notice Requirements <br />Within ten (10) days after filing, mail Or per:;onally serve a Copy of the notice <br />described in Rule 3.2<3)(b)(ii1) to to ail owners of record of surface rights to the <br />affected land and all owners of record of lands that are rtthin 00 feet of the boundary <br />of the affected land tRuie 3.2t3)tb>(iv)tA) and tB)). In addition, you should publish <br />once in a new a er of gene rat circulation, in the locality of the proposed mining <br />operation, the no ce described in Rule 3.2t3)t9>(i11).
