REPLACE>\1ENT ~0'ATER <br />The total calculated mining depletions for the Duckworth Pit for the remainder of Water 1"ear 2004 <br />are ] 2.3 acre-feet with only 2.5 acre-feet of the lagged depletions being realized at Boulder Creek <br />(Table No. 3). ]n 2005, the total calculated depletions for the mining operation are 26.9 acre-feet <br />with approximately 14.8 acre-feet of lagged depletions requiring replacement (Table No. 3). <br />Replacements will be made from the storage and release of water from a lined reservoir owned by <br />Lafarge known as Heaton Reservoir (Figure No. 1). Lafarge owns 2.0 Rural Ditch shares, which <br />have been approved by the SEO in a H.B. 14]4 SWSP and are included in Case No. O] CW 194 for <br />storage and release from Heaton Reservoir. The SWSP for Heaton Reservoir yeas appro~'ed by the <br />SEO in a letter dated August 28, 2003. The liner for Heaton Reservoir was approved in a letter from <br />Dave Nettles dated April 7, 2003. Copies ofboth letters are included in Appendix B. <br />The historic accretions and depletions for the 2.0 Rural Ditch shares was determined to be 86.8 acre- <br />feet and was approved by the SEO in the SWSP (Table No 3). The total historic farm headgate <br />delivery for these 2.0 shares is 174.5 acre-feet (Table No. 3). Condition No. 3 of the S'.'•'SP <br />approvals sets the historic farm delivery as the annual volumetric limit that can be diverted into <br />Heaton Reservoir. The required portion of the annual diversion into.Heaton Reservoir will be <br />released to meet return flow obligations for the 2.0 shares. The applicant previously developed and <br />submitted to the SEO an accounting form to track the Heaton Resen~oir operations. This form will <br />be utilized by Lafarge to track reservoir operations. A copy of this accounting form is included in <br />Appendix B. <br />Lafarge proposes to store its 2.0 Rural Ditch shares in Heaton Reservoir and then pump the water <br />directly for use in a concrete batch plant that lies adjacent to the reservoir known as the Heaton Batch <br />Plant. The Rural Ditch water will be diverted and delivered to Heaton Reservoir through an existing <br />lateral and a flume and recorder will be installed to measure diversion rates and volumes. A>.'ater will <br />be pumped out of Heaton Reservoir to make mining replacements according to the timing shown in <br />Table No. 3. <br />An existing batch plant at the Heaton Reservoir pumps up to a maximum of41.4 acre-feet per year <br />of the historic consumptive use credit from the Rural Ditch shares stored in the reservoir. Alain, the <br />2.0 shares have 86.8 acre-feet ofhistoric use credit ofwhich only41.4 acre-feet will be consumed at <br />the concrete batch plant. There will be sufficient excess historic consumptive use credit remaining in <br />the reservoir to make replacements for the mining depletions associated with the Duckworth Pit <br />throughout 2004 and 2005 (Table No. 3). <br />Since Heaton Reservoir makes releases inro St. Vrain Creek. just downstream from the confluence <br />with Boulder Creek, District 5 Water Commissioner Scott Edgar was contacted and he gave his <br />approval for the releases from the Heaton Pit for replacements For this site. Mr. Edgar coordinates <br />releases from the Heaton Pit under the current SWSP. <br />Holvever. the Duckworth Pit depletions occur in District 6. y~~ater Commissioner Bob Carlson was <br />contacted, and he cave his approval for the use of the 2.0 Rural Ditch shares and Heaton Reservoir <br />Page 4 <br />
