(LaFarge) Heaton Property Batch Plant, pursua to C.R.S. ;,r-92-008(4). P,ccording to the submitted material, an application for a change e~ v:ater right was filed with the Division 1 Water Court under case no. 2001 CW 194, for rivo shar=s of Rural Ditch water, and an application for a water storage right was filed under case no. 2001 CW 193, for the Heaton Reservoir. All objectors to the cases have been notified of this application for a substitute water supply plan (SWSP). The notice was sent on July E, 2003. The State Engineer's Office (SEO) r=ceived an objection to the SWSP from the Rural Ditc:^, Company and their comments have been consid=red in this approval. The statutory 30-::ay comment period has passed and the S300 filing fee has been received. Plan Operation L2Farce owns two shares o; Rural Ditch water. Under this plan, LaFarge propos=_ is siore the Rur21 Ditch ware,- in the Heaton Reservoir, then pump it directly from the reservoir for use in concrete batchinc ai the Heaton Batch Plant. The Rural Ditch water wilt be delivered to the res=^:oir ihroueh the existine lateral, which will have a flume and recorder to measure the c^:ersion raie_. and volcmes. The Heaton Reservoir was created by sand and gravel mining activities, which wore completed in 2001. This reservoir has been lined with a compacted berm. The 90-day liner asst was iampleted and the pit was approved for storage in a letter from Dave Nettles dated Apri; -, 2003. Case nos. 2001 C1N193 and 2001 CW 194 were amended to add two wells or infiltration galleries, which will divert water from the St. Vrain, for storage in the Heaton Reservoir- The diversion points will be located within i UO feet of the stream and will acl as headae.es to v/ith~rav: water from the St. Vrain when there is no call on the stream.
