STATE OF COLORADO
Roy Romer, Govei
DEPARTMENT OF NATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
FRED R. BANTA, Director
DATE: September 7, 1988
T0: Michael B. Long
FROM: James C. Stevens BLS
RE: Golden Eagle Mine (Permit C-81-013) Cessation Order C-88-017,
Extension of Time for Abatement
This proposed extension until October 4, 1988 is for 90 days which should
enable Wyoming Fuel Company to complete Step 3 which is the last step required
for abatement of this violation. This violation was issued April 7, 1988 and
the initial 90 day period for abatement elapsed July 6, 1988. Step 2 of the
abatement was to submit a complete and adequate technical revision, according
to the requirements of the Division, describing in detail the entire system of
mine water treatment and monitoring to be employed at the mine. Due to the
extent of the regulations applicable to the AVF location in which the expanded
treatment facility was proposed, Step 2 was not completed until June 10, 1988.
Step 3 was to secure final approval of the revision within 70 days of its
receipt. Again due to the complexity of the problem, the Division has not
been able to approve the proposed TR either by July 6, 1988, 90 days after
issuance of the violation, or by August 19, 1988, 70 days from the Step 2
abatement. Since the additional time required for abatement of this violation
was not necessarily due to a lack of diligence on the part of the operator or
within the operator's control, it is believed that an extension of the
abatement date is justified.
OOIOF/scg
215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
