The Pemuttee, United Companies of Mesa County, Inc. desires to conduct a muting operation <br />(mown as Piceance Pit, for the purpose of exUading sand and gravel. The Pemrittee will nd mine any secondary <br />commodities. <br />B. On August 22, 2001 the Mined Land Reclamation Board (the "Board") approved the <br />Pennittee's application for this permit, fixed the amount ofthe financial warranty and directed that this permit be <br />issued upon the filing with the Division of Minerals and Geology (the "Division") of performance warranty and <br />financial warranty (or wartarrties) m the amount so fixed ur form and substance approved by the Division. Said <br />warranties have been filed with the Divisicn. <br />C. Ifthe Pernittce desires to extract materials other than those listed ur (A), a separate pemtit may <br />be required. <br />D. On August 22, 2001 the Board made the following fmdings: <br />1. The application for this permit complies with the requirertraAs ofthe Colorado Mined <br />Land Reclamation Ad for the Extraction of Conshuction Materials, C.RS. 34-32.5-101 et sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will nd adversely aixed the stability of any sigrrificarrt, valuable, and <br />permanent man-made structure located within two hundred feet of the Affected Land, except where there is an <br />agreement between the Operator and the persons having an urterest in the struchrm that damage to the structure is <br />to be compensated for by the Pertnittee; and; <br />
