UNION CARBIDE CORPORATION __ ("operator") desires to con- <br />duct a mining operation known as West Sunda~Mip~_,_____ <br />for the purpose of extracting nranir,m-vanari; ,,m <br />3. On =~ri1 23 _~~ 1981 r the Mined Land Reclamation <br />9oar0 ("the boar ") approved operator's application for <br />this permit, fixed the amount of bond and directed that <br />this permit be issued upon the filing with the Hinetl Land <br />declamation Division ("the division") of bond in the amount <br />so fixed together with surety or sureties thereon in Form <br />and substance approved by the division. and such bond and <br />sureties have been so furnished. <br />C. The board on ~pr;l Z'i_, 19d1 made the following find- <br />ings: <br />L. the application for tnis permit complies with the <br />require menus Of the Colorado Minetl Ldnd Reclamation <br />act, C.R.S•. 1973, 34-32-101 g~,sen°. as amended ("the <br />act") and with all applicable local. state and federal <br />laws; <br />2. the operation will not adversely affect the stability <br />of any significant. valuable. and permanent man-made <br />structure located within two hundred feet of the affected <br />lantlr exce~~t where there is an agreement between oper- <br />ator and [tie persons having an interest in the struc- <br />ture that ciamage to the structure is to be compensated <br />for by operator; and <br />3. the proposed mining and reclamation operations can be <br />carried out in conformance with the requirements of <br />the Act. <br />D. Operator has made a showing satisfactory to the board: <br />(1) that ;t will employ. during and after its underground <br />mining and surface operations, procedures reasonably designetl <br />to minimize, as much as practicable, environmental disturb- <br />ance from such operations; (2) that it will provide for <br />reclamation of the affected lards appropriate co the subse- <br />quent beneficial use of such lands; and (3) that, ;n the <br />event of the failure of its proposed reclamation plan, it <br />will take whatever measures may be neCe55dry to assure the <br />success of reCldrndtiOn of the lands affected by such Oper- <br />
