Long subject: Review of Sedimentation Pond H Inspection Report Division Dueclor Permit C-81-017, 4th Quarter 1998 date: April 4, 2001 This review was conducted to determine compliance with Rule 4.05.6(13). Was the inspection report submitted promptly as required by the Division? The reports are to be submitted in accordance with 30 CFR 77.216-3 [Permit Application Package (PAP) page 816-44 paragraph 816.45([)]. This reference requires reporting promptly [CFR 77.216-3(c)]. Rule 4.05.6(]3) is more descriptive (and perhaps more demanding), requiring reports be submitted promptly on a quarterly or annual basis, as required by the Division. During my review of the PAP, I found no such requirement by the Division. The inspection was accomplished on 11/18/98. The subject report was submitted on January 8, 2001, and received at the Division on January 10, 2001. Was the pond inspected for structural weakness? Yes Was the pond inspected for erosion? Yes Was the pond inspected for other hazardousconditions? Yes Is the report certified by a registered engineer? No Is the sediment level reported? Yes Is required maintenance reported? Yes There is a potential maintenance requirement. Leakage was noted around [he riser. Recommend that the PAP be revised to identify the time period and submittal date of the reports. Some PAPS require submittal of the reports monthly, by the 30`h of the month following. The Colowyo reports are due on an annual basis as part of the Annual Hydrologic Report. If a revision to the PAP is inappropriate, I suggest a letter of [he Division establishing [he requirement (a copy filed in the PAP next to page 816-44). Recommend certification of the (future) reports by a registered engineer (a registered engineer cannot certify an inspection in which he did not participate). Complete certifications are described in the Policy Memorandum of July 13, 1984, but I have noticed common practice in the Division is to accept a PE stamp as sufficient. The copy of the report I reviewed is attached.
