Mr. Mike Boulay <br />Divirion of Mineralr and Geology <br />Page 2 <br />Discharge from the french drain was monitored twice. Results from the monitoring are attached. Review of <br />the data indicates that the water is suitable for agricultural use, compared to CDPHE surface water <br />agricultural standard. Since the creation of the french drain, no ezceedances of NPDES effluent standards <br />have occurred downstream at Pond 016. <br />SCC has received a letter from the landowner, George Priederich indicating that they would like to retain the <br />wells. A copy of the letter is attached. Apparently, what they are really interested in is the water. SCC <br />suggests that the landowner be allowed to file a water right on the french drain discharge after final bond <br />release In the mean time, since the lower portions of the wells cannot be Filled with abandonment material, <br />SCC suggests that the upper portions of the wells be filled with bentonite pellets. This would prevent any <br />artesian Flow from discharging through the wellheads. I-[owevex, flow will likely continue to discharge <br />through the french drain. This water will come from suspected breaks in the PVC casings at some point at or <br />below the pinch points. <br />We believe that we have~eshausted all possible abandonment options, and it may be necessary to seek a <br />variance from approved abandonment procedures. y~/e would Gke to discuss with you and the DIX/R the <br />present situation with these wells. We would also like to consider the possibility of transferring ownership of <br />the wells to the Friederich's following bond release of the mine site.
