Rule 7.2.3(2) allows for an extension, but that extension cannot exceed <br />one year from the date that Mine Development Inc. IMDII was notified that an Environmental Protection Plan <br />IEPP1 would need to be submitted. This notification was incorporated into the Division's letter to MDI dated <br />December 8 1995. It is assumed that this letter reached MDI on December 11, 1995. Therefore, a one year <br />extension is approved. The revised due date for submittal of MDI's EPP for the Neglected Mine is <br />December 11, 1996. <br />This extension is granted because of the short season of access to the mine site due to weather conditions, <br />and because the site may be "cleaned up" this next operating season, to the point where the Neglected Mine <br />no longer qualifies as a Designated Mining Operation. If the site is adequately "cleaned up", and the analysis <br />of the ore, tailings and waste rock at the Neglected Mine indicates that the site does not have the potential <br />to produce toxic or acid mine drainage conditions, then submittal of an EPP may no longer be required. <br />If you have questions or need additional information, please contact me at our Durango Field Office, 1474 <br />Main Avenue, Room 207, Durango, Colorado 81301, phone no.
