As you aze <br />awaze, since the date of your letter, we have had numerous discussions regarding the status of the <br />pond, with participation by yourself, Larry Routten and Dave Berry of CDMG and Juan, Rich <br />and myself of Colowyo. What I intend to do today is to respond [o the issues as we have now <br />come to understand them. <br />CDMG Comment # 1 <br />We have attached for your information, a plan view map and cross section showing the <br />relationship of the East Taylor pond embankment to original ground level after removal of <br />topsoil. Note that the pond is, in part, an incised pond with a portion of the pond volume <br />provided by the embankment and a portion provided by the excavation. The elevation of the <br />spillway is approximately 6954' and the elevation of the inside toe of the pond embankment is <br />approximately 6938.6'. As such, the height of the embankment structure, when measured at the <br />inside toe, is 15.4 feet. <br />According to Rule 1.04 (40) "embankment" includes only that portion of the pond "above <br />the natural surface of the land."
