Topsoil and overburden piles will need to be placed so they are not affected by the mining plan. In <br />particulaz the east topsoil pile in pond 2 and the southwest piles in pond 2. Please further describe how <br />the topsoil and overburden piles will not be affected by the mining operation. <br />16. On the Civil Resources stability letter of March 22, 2005, the final noted number 5 was not included as <br />a note on the map. This note states, "The maximum allowed encroachment of the mine slope to toe of <br />WCR 6 and WCR 8, further than 1300 feet from Highway 85 is 65 feet." Please add this note to <br />Exhibit 3 of 7. The Division was unable to locate this note on the revised map. <br />Please be advised that Lupton Lakes Resource application may be deemed inadequate, and the application <br />may be recommended for denial on April 19, 2005 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written waiver of <br />your right to a decision by April 19, 2005 and request for additional time. This must be received no later <br />than the deadline date.
