1993 <br />CERTIFICATION OF <br />WEST ELK MINE <br />FRESH WATER POND FW-1 <br />This annual certification is prepared in compliance with Rule 4.05.9110) and <br />4.05.6113) of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining. <br />Jim D. Miller, the Certifying Engineer, has been working in the engineering <br />field for more than 8 years and has experience in the construction and inspection <br />of fills and embankments. He is a registered Professional Engineer in the State of <br />Colorado. <br />Fresh Water Pond FW-1 has been maintained in compliance with prudent <br />state-of-the-art and with West Elk Mine's approved Mining and Reclamation Plan <br />(MRP) to store water which is pumped from the North Fork of the Gunnison River. <br />FW-1 supplies raw water for potable use, dust suppression, and fire suppression. <br />FW-1 is an engineered earthen-fill embankment with 3H:1 V sideslopes. The pond <br />is lined with asemi-impermeable clay liner. Pond FW-1 specifications can be <br />found in Exhibit 44 and Exhibit 49 of the MRP. <br />Fresh water pond FW-1 was visually inspected for erosional and structural <br />conditions and no problems were observed. <br />J' D.
