1993 <br />CERTIFICATION OF <br />WEST ELK MINE <br />SEDIMENTATION POND MB-1 <br />This annual certification is prepared in compliance with Rule 4.05.9110) and <br />4.05.6(13) of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining. <br />Jim D. Miller, the Certifying Engineer, has been working in the engineering <br />field for more than 8 years and has experience in the construction and inspection <br />of fills and embankments. He is a registered Professional Engineer in the State of <br />Colorado. <br />Sedimentation MB-1 has been maintained in compliance with prudent state- <br />of-the-art and with West Elk Mine's approved Mining and Reclamation Plan (MRP) <br />to retain runoff from disturbed areas. The specific size and capacity of MB-1 is <br />presented in Exhibit 44 and Exhibit 47 of the MRP. Stability analyses are also <br />presented in Exhibit 44. <br />Sedimentation pond MB-1 was visually inspected for erosional and structural <br />conditions. Presently clear seepage exists at the toe of the embankment on the <br />northwest and northeast sides of pond MB-1. There are no signs of structural <br />degradation as a result of the seepage and no erosional problems were observed. <br />Ji" D. Miller <br />.E.
