Drawer D <br />Hdyden, Colorado 81639 <br />Re: Seneca and Nucla Mines Quarterly Sediment Pond Inspections, <br />Pernlit Nos. C-80-005 and C-81-008, Respectively <br />Dear: <br />We have received the recently received fourth quarter reports for the <br />referenced mines. Below are some concerns identified during this review. <br />Please respond to the following at you earliest convenience. <br />;Y. Rule 4.05.6(11)(c) requires quarterly sediment pond inspections; there is <br />'''o% Peabody couldastop submitting themquarterlyepond inspectionsdforrthe Mesa <br />Gravel Pit Impoundment (Minerals Permit No. M-82-036). <br />,`P; The approved designs for the Nucla sediment ponds specify non-clogging <br />dewatering devices. A review of the inspection reports indicate Pond <br />Nos. 001, 005 and 006 have trash racks; it appears the other ponds have <br />no such non-clogging structures. Please indicate when non-clogging <br />devices will be placed on the ponds requiring such devices. <br />3. The report for Pond No. 003 at Seneca addresses water leakage around the <br />spillway pipe. A review of previous reports indicates this problem has <br />,~ ~- been prevalent for some time with an attempted fix in July, 1985 <br />~'~~°„~ unsuccessful. Please address what plans are being developed to fix this <br />~,,~ problem. <br />4. The report for Pond No. 004 at Seneca addresses some cracks on the pond <br />with one in particular measured at 1-2" wide and 6-12" deep. From <br />° previous reports, it appears this was first noticed during the third <br />quarter inspections.
