Because of our desire to avoid clouding the MR-33 ditch <br />issue with issues pertaining to ponds, on January 2, 1995 Colowyo contacted the Division <br />stating our intention to address these two issues separately. The purpose of this letter is to <br />address the pond issues. Our response regarding the MR-33 issues will be forthcoming <br />under separate correspondence from Juan Garcia. <br />1- I«~~P #1 (from the December 28. 1995 CDMG Correspondence) <br />Juan Garcia will forward the revised map shortly. <br />2- Issue #2-a <br />A revised Permit page will also be included with Juan's information, providing <br />additional clarification regarding this issue. <br />It is important to note that none of the sedimentation ponds at Colowyo are designed <br />with a permanent pool! Sedimentation ponds at Colowyo are designed to store or contain <br />the design event rather than "treat" the event. All sedimentation ponds are provided with a <br />headgate designed to safely release water from the ponds as soon as the water quality <br />meets the applicable discharge standards. The general practice is for the ponds to be <br />emptied as soon as possible rather than store water for an extended period of time. The <br />pond releases are managed to remain in compliance with both the State Engineer's <br />Regulations and WQCD, CDPS discharge standards. <br />The clear benefit of our pond configuration is that we can control the releases of <br />water to insure that the effluent meets the discharge standards. Automatic water discharge <br />mechanisms (siphons, perforated pipes or combination spillways for example) have the <br /> <br />
