Kubic and Hernandez: <br />Attached is a detailed response to the subject letter. As stated by both myself and members of our staff, we are <br />deeply concerned about the contents of the letter. The letter was received at a time when we were looking <br />forvuard to the opportunity to review a revised Rationale and Permit document which reflected the comments we <br />had communicated to the Water Quality Control Division during the Public Comment period that ended October <br />8, 1997. <br />It is Colowyo's intent to fully comply with the conditions of all existing and future permit conditions. We are <br />committed to working with the agencies to develop a new water discharge permit that meets the intent of the <br />regulatory requirements while reflecting the appropriate operating conditions of the mining operation. <br />As has been discussed this past week we would recommend that, if appropriate, a meeting be held to move these <br />issues forward. The decision on such a meeting should be made after you have had a opportunity to review these <br />materials. Let me reiterate, we wish to spend our energies on moving the process forward so that a new permit <br />can be developed and issued.
