Nolan, MD, MPH <br />fxecutive Director <br />The Division of Minerals and Geology (DMG) recently requested the Solid Waste Section of <br />the Hazardous Materials and Waste Management Division (the Division) to determine <br />requirements under the Solid Waste Regulations for Southwestern Portland Cement's proposed <br />quarry operations at Dowe Flats, located in north Boulder County. To facilitate this <br />determination, a meeting was held at DMG offices on December 29, 1993. This meeting was <br />attended by representatives of the Division, DMG, and Southwestern Portland Cement. <br />Prior to the meeting, it was our understanding that cement kiln dust (GIGO) would be disposed <br />of in the quarry pits remaining after mining at Dowe Flats. Since the Dowe Flats property is <br />separated from the plant property, this disposal may have required a Certificate of Designation. <br />Based on our discussions, the disposal of CKD will take place in a disposal facility located on <br />the Lyons Plant property and covered by the current Mined Land Reclamation Board (MLRB) <br />permit. As we discussed on January 24, 1994, this method of disposal was approved by the <br />MLRB as disposal of mine waste in the MLRB permit issued for this facility i^ 1969. This <br />disposal is acceptable to the Division, pursuant to C.R.S. 30-20-102 (4), which allows for mine <br />waste to be disposed of within the MLRB permit area. Since no CKD will be disposed of at <br />the Dowe Flats property, the Division cannot require a Certificate of Designation in this case. <br />I hope that this letter clarifies the Division's position on this matter.
