The Applicant proposes to use this time delay to <br />evaluate riverbank stability and the stabilization provided by existing concrete rubble riprap. Other <br />stabilization measures may also be installed prior to mining within 400 feet of the river. The proposed <br />stabilization techniques may include: <br />• minor bank regrading, <br />• burial of concrete ruble armoring, and <br />• planting and seeding of appropriate stabilizing bank vegetation. <br />These proposals are acceptable for a recommendation from the Division to approve the application. <br />However, in order to incorporate the proposed actions into a reclamation permit, they must be framed in <br />an enforceable language, which is not the case in the Applicant's May 24, 2000 response. The <br />following stipulation to approval is recommended: <br />Prior to mining within 400 feet of the top of the bank of the South Platte River, the Operator <br />will provide and gain approval of a technical revision that includes an evaluation of the stability <br />of riverside berms to be left at the conclusion of mining. <br />c:\windows\pcrso nal\ri verbend3. doe <br />
