Owens Brothers Concrete <br />has historically purchased construction aggregates from commercial producers for use in <br />their ready mix concrete business. The company purchased the Del Camino property in <br />1985 with the intent of eventually permitting it and mining the aggregate for their own <br />internal use. Last year we gained approval from the Weld County Commissioners, filed <br />the CMLRB application and filed the Substitute Water Supply Plan with the Division of <br />Water Resources (copy of application document attached to this letter). The company's <br />intent is to initiate mining in the next year or perhaps two and obviously wants and needs <br />all permits in place. Detailed, final plans for the operation have not been formulated. For <br />this reason we would like to gain permit approval from the Division now and submit the <br />various details that you have requested later, when they are known. Submittal of these <br />details will be a precondition to land disturbance along with the submittal of a financial <br />warranty for reclamation. <br />Item #1: Discharge Permit <br />The applicant has not yet applied for a Colorado Discharge Permit System (CDPS) permit <br />to the Colorado Dept. of Public Health and Environment (CDPHE). According to the <br />Substitute Supply Plan submitted to the State Engineer (on January 21, 1997), water from <br />the dewatering operation will be discharged into St. Vrain Creek. The exact location of <br />the discharge point is not curcently known but will be shown in the CDPS permit <br />application. <br />The applicant will provide the Division with verification that the CDPS permit has been <br />approved prior to any mining disturbance. We request that this be a condition of permit <br />approval. <br />
