The inspection also satisfies Rule 4.05.9 (13) of the Colorado Mined Land Reclamation <br />Board for Coal Mining. They were re-inspected on June 26, 2002, after the first significant rainfall since <br />they were constructed. All ponds had received some inflow. None were discharging at the time of <br />inspection and no significant new erosion was noted. Discharges had been recorded for Pond 9 during <br />September. <br />To the best of my knowledge, based upon my field observations and investigations, as detailed in the <br />attached inspections reports, all referenced ponds are being maintained in conformance with prudent, state- <br />of-the-art earthen embankment construction. <br />Sincerely, <br />,k,c-~c~-id~ _ <br />Ronald G.
