The inspection also satisfies Rule 4.05.9 (13) of the Colorado Mined Land Reclamation
Board for Coal Mining. They were re-inspected on June 26, 2002, after the first significant rainfall since
they were constructed. All ponds had received some inflow. None were discharging at the time of
inspection and no significant new erosion was noted. Discharges had been recorded for Pond 9 during
September.
To the best of my knowledge, based upon my field observations and investigations, as detailed in the
attached inspections reports, all referenced ponds are being maintained in conformance with prudent, state-
of-the-art earthen embankment construction.
Sincerely,
,k,c-~c~-id~ _
Ronald G.
