Cattany <br />Acting Division Director <br />The Division of Minerals and Geology has reviewed the sediment pond reports for the above mentioned <br />period submitted by Greg Lewicki and Associates for the Rimrock mine. <br />These reports comply with the requirements of Rule 4.05.6(13) for inspection of sediment ponds at coal <br />mining sites. Generally, the pond holds water only for limited periods after storm runoff events. <br />Adequate sediment and water storage capacity, spillway function, and embankment stability was noted <br />during each of the inspections. Mr. Lewicki noted no remazkable observations. Drought conditions <br />limited vegetative growth but pond embankment erosion does not appear to be a problem at this time. <br />Based on our independent observations during field inspections we concur with the observations as noted. <br />We have no questions regarding these reports.
