STATEMENT OF CASE <br />A. Nature Of Case and Disposition Below <br />This is an action for judicial review pursuant to <br />C.R.S. 24-4-106 (1988 Repl. Vol.) of a decision of the Mined Land <br />Reclamation Board ("Board"). On March 22, 1989, the Board <br />granted the Section 112 Reclamation Permit Application <br />No. M-88-112 ("Application") submitted by Defendant Battle <br />Mountain Resources, Inc. ("Battle Mountain"). (Vol. 1, p. 1.)1 <br />B. Course of Proceedings and Statement of Facts <br />On November 10, 1988, Battle Mountain filed i.s <br />Application with the Mined Land Reclamation Division ('NERD"), <br />seeking a permit for a silver and gold mine and processing <br />facilities including a mill and a cyanide heap leach <br />("Project"). (Vol. 4, p. 912.) The Project is located on 2,200 <br />acres of land five miles northeast of the town of San ]~uis, <br />Costilla County, Colorado. (Vol. 6A, p. 960.) The mining <br />operation will result in the removal of approximately :.3 million <br />tons of ore from the hills around San Luis over a 7-10 year <br />period.
