<br />Re9uirements of Section 4.05 9 13) for Permanent Impoundments <br />(A) Quality of water shall be suitable on a permanent basis for its intended use and <br />dischazge shall meet all applicable State and Federal water quality standards. <br />Although the runoff from the drainage area into the pond is expected to be slightly <br />alkaline (pH 8.0), the quality is well within CWQCC basic surface water standards and <br />CWQCC instream standards. The discharge will also meet all State and Federal <br />standards. <br />(B) The level of water shall be sufficiently stable and the configuration of the pond <br />shall be adequate to support its intended use. <br />The pond holds water below the principal spillway pipe during spring snowmelt and in <br />response to summer and fall rains. During these periods, the water level is sufficiently <br />stable to provide an alternative watering source for cattle, which the owner intends to <br />graze on the site. <br />(C) Adequate safety and access to the impounded water shall be provided for the <br />proposed water users. <br />The slopes leading to the pond are milder than 9H:1 V, therefore, they are easily <br />accessed by cattle and wildlife. <br />(D) Water impoundments shall not result in the diminution of water quality or quantity <br />of water available to water rights holders for agricultural, industrial, recreational or <br />domestic uses except in accordance with applicable State law. <br />The pond can only hold water up to the principal spillway pipe (4" steel pipe). Any <br />storms delivering water higher than this will be dewatered within 24 hours. Based on <br />the State-Storage relationship for the pond, approximately 0.27 acre-feet of storage is <br />available below the principal spillway. This amount is insignificant and does not <br />constitute a water rights issue. The planting of grass on the reclaimed area has <br />prevented mote water from reaching Trout Creek than the pond impoundment. <br />(E) The size of the impoundment is adequate for its intended purposes. <br />The pond size is adequate for occasional watering of cattle and wildlife. <br />(F) The impoundment is suitable for the approved post-mining land use, <br />The pond is certainly suitable for the post-mining land use of cattle grazing. The pond <br />has been used in the past by cattle and wildlife (during the bond release period) and <br />there is no reason to believe it would not be suitable in the future. <br />~ ~~- ~ <br />-77z / 3 <br />
