Adequacy Review, File No. M-2001-038 <br />Dear Mr. Lincoln: <br />Listed below aze adequacy review comments on your Regular 112 Application for the above-captioned <br />operation. The decision date for your application is scheduled for July 5, 2001. Therefore, I would <br />appreciate a response from you on or before June 22, 2001. Any public comments that we receive on your <br />application during the interim will be forwarded to you. Please be advised that your application may be <br />deemed inadequate and may be denied on July 5, 2001 unless [he following adequacy. review items are <br />addressed [o the satisfaction of the Division. <br />6.4.3 EXHIBIT C -Pre-Minine and Minine Plan blap(s) of Affected Lands <br />1. An April 20, 2001 Division of Wildlife (DOW) letter addressed [o Carl Mount of the Division of <br />Minerals and Geology (DMG) indicates an uncertainty of whether the proposed pit extends south to 64th <br />Street and includes the Kiowa Creek waterway and trees or whether such areas are completely outside the <br />proposed permit area. Please clarify. <br />6.4.4 EXHIBIT D -Minine Plan <br />2. The Applicant indicates on page 2 of the application form that oil products for minor equipment <br />maintenance will be used or stored within the permit area. Please describe the type grid volume of <br />oiUpetroleum products to be used or stored on site, where they will be stored, and any containment <br />measures that will be used to ensure protection of groundwater in the event of a leak or spill. Please <br />respond. <br />3. Please clarify the depth of overburden to be removed, the depth of deposit to be mined, and the overall <br />pit depth. <br />4. The Applicant indicates in the mining plan that the Bennett Pi[ #2 will be a dry pit and no groundwater <br />will be encountered. The index map shows that the southeast comer of the permit area is adjacent to <br />Kiowa Creek. Accordingly, please provide a commitment to stay at least two (2) feet above the <br />groundwater table at all times. In the unlikely event that groundwater is exposed, the operator will need to <br />
