Martinek: <br />The division has reviewed the MLR application for a permit to conduct mining <br />operations submitted by B S B Excavating Inc. <br />Any point source discharge of pollutants to waters of the state requires a <br />CDPS permit from this division prior to say discharge. The entity should be <br />advised of this requirment, review their operation accordingly and make <br />application for any discharge at least 180 days prior to the desired date of <br />discharge. <br />Exhibit D, page 8, refers to a fuel storage area. The permittee should be <br />advised that they may be required to prepare a Spill Prevention Control and <br />Countermeasure Plan (SPCC Plan) by EPA. They should contact EPA Region VIII <br />about these requirements.
