1 <br /> <br />' EXHIBIT D <br />MINING PLAN AND TIMETABLE <br />' Location. The proposed site is located two miles east of <br />' Interstate Highway 25 and a mile north of State Highway 119. <br />The location is approximately 8 miles east of Longmont, Colorado. <br />' Mining activity will occur on the north and south sides of St. Vrain <br />Creek. <br />1 History. In August 1973 the surface and mineral rights <br />' to all of the property, except for the minerals owned by the <br />State of Colorado in the E/2 SE/4 of Section 36, T3N, R68W, were <br />' purchased by J-Bar-B, Inc. In April 1984 the State Board of <br />Land Commissioners issued a permit to mine state minerals underlying <br />' the E/2 SE/4, Section 36, the surface of which is owned by J-Bar-B, <br />' Inc. <br />Current Conditions. Map Exhibit C shows the outline of <br />' the affected land, touching landowners, topography, hydrologic <br />factors and existing facilities. A small part of the property <br />' is occupied by a farmhouse and outbuildings; the remainder is <br />' irrigated land on the south one-third and creek bottom on the <br />northern two-thirds. Various areas in the northern part are <br />' cultivated from time to time. <br />Three gas lines, two operated by Colorado Interstate Gas <br />' Company and one operated by Panhandle Eastern Gas Company, cross <br />' the property on rights of way as shown on the map exhibit (also <br />see Appendix, "Gas Production Pipelines"). <br />1 <br />' S <br />
