It is a provision ofthis permit that the operations will be conducted in accordance with the tentts and cotditions <br />listed in your application, as well as with the provisions of the Act and the COt4SkUCtion Material Rules and <br />Regulations in effect at the time the permit is issued. <br />/~i%~ 9. Annually, on the anniversary date of perarit issuance, you must submit an armual fee as specified by Statute, <br />and an annual repots which includes a map desrn'bing the acreage affected and true acreage reclaimed to date (ifthere <br />are changes from the previous year), arty trtonitoting required by the Rcelamation Flan to be submitted amtuallyon <br />the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example, a <br />permit with the anniversary date of July 1, 1995, the annual fce is for the period of July i, 1994 through June 30, <br />1995. Failure to submit yow annual fee sad report by the permit anniversary date Wray result in a civil penalty, <br />revocation of your permit, and forfeiture of your financial warranty. It is your responsibility, as the pu:rrrtittce, to <br />continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. <br />N ~ 10. ForFor joint~~~~~: the signing representative is atnhorized to sign this document and a <br />power of attomcy (provided by the partncr(s)) authorizing the signature of the representative is attached to this <br />application. <br />P t ondition: <br />O A reportable spill is a spill of any toxic or hazardous substance (including spills ofpetroteum products) within the <br />mined land permit area reportable to any Division of the Colorado Deparurtent of Public Health and the Environment, the <br />National Response Center, the Colorado Emergency Planning Commission, any local Emergency Phoning Commission, <br />local Enxrgency Platming Cottunittee, or rice Slate Oil inspector. The Mine Operator shaft notify the Division of <br />Reclamation, Mining and Safety (DBMS) of a reportable spill within the mined land prnrrit area using the same timeframe <br />required by the permit, license, notice, statute, cute or regulation governing the reporting of the spill to the other appropriate <br />agency. Notice ofa reportable spill shall be FAXed to: Minerals Program Superviror, Division ofRecJamation, Mining and <br />Safety, FAX (303) 832$106. The FAX shall include atoll-back number ofa responsrble cov~any official for DBMS staff <br />to use as a contact. <br />
