Gem Mine, File No. M-2007x003, Receipt of 110(2) Hard Rock/Metal Mining <br />Reclamation Permit Application Package <br />Dear Mr. Rubeck: <br />On January 17, 2002, the Division of Minerals and Geology received your the 110(2) Hard Rock/Metal Mining <br />Reclamation Permit Application package for the Topaz Mt. Gem Mine, File No. M-2002-003. Preliminary <br />review ofthe information received determined that the following items must be received before the Division can <br />wnsider your application as being submitted and technical review can begin: <br />APPLICATION FORM: Item 1: Needs completing. Page 2: The Division requires some <br />clarification as to the Permittce name desired. On page 1, there is nothing listed. On page 2, Topaz <br />Mt. Gem Mine is listed. And an page 5, WaR Rubeck is listed as a parUrer of Topaz Mt. Gem Mine. <br />Page 4: Missing. Page 5, Signature Page: The Division requires that the notary section reflect the <br />Permittce desired. <br />EXHIBIT B -Site Description (Rule 6.3.2fa)): You must address Item (a) to the extent necessary to <br />demonstrate compliance with the applicable performance standard requirements of Rule 3. At a <br />minimum, you must include a description of the vegetation and soil characteristics in the area of the <br />proposed operation. The local office of the Natural Resources Conservation Service (MRCS) may <br />provide you with this information as well as recommendations for Exhibit D -Reclamation Plan; <br />EXHIBIT G -Source of Leal Rieht-to-Enter (Rule 6.3.7): Provide a description of the basis for <br />legal right of entry to the site and to conduct mining and reclamation. This may be a copy of access <br />lease, deed, abstract of title, or a current tax receipt. A statemerrt by the Landowner and aclmowledged <br />by a Ndary Public stating that you have the legal right to enter and mine is also acceptable. <br />EXHH3IT I -Proof of Filin¢ with County Clerk (Rule 6.3.9): Provide an affidavit or receipt <br />indicating the date on which the application was placed with the local County Clerk and Recorder. <br />Also, refer to Rule 1.6.2(1)(c). <br />Your application will not be considered filed until the information listed above is received and found sufficient <br />to begin our review. A decision date will be established 30 days from the date of receipt of all of the requested <br />information. Additionally, if you have already published notice you will need to republish notice, after the <br />Division considers the application submitted. Republication must occur once within ten (10) days of the <br />submittal date. We will noFify you when you should initiate republication of your notice. The final date for <br />
