<br /> <br />April 5, 1996 <br />COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT <br />WATER QUALITY CONTROL DIVISION <br />Public Notice of Intended Civil Penalty <br />R~r nce of Pnhlir Nnticr: The purpose of this public notice is to state the intent of the Colorado <br />Department of Public Heal[h and Environment's Water Quality Control Division ("WQCD") to <br />petition for the imposition of a civil penalty of $11,136 cash against Trinidad Basin Mining <br />Company. This penalty is sought pursuant to the Water Quality Control Act, §25-8-608, C.R.S., <br />for violations of the Wa[er Quality Control Act as alleged in the Notice of Violation and Cease and <br />Desist Order issued by the ~NQCD or. December 15, 1992. <br />Trinidad Basin Mining Company owned and operated the Trinidad Basin Mine in Las Animas <br />County, Colorado. The alleged violations involved unpermitted discharges of pollutants to State <br />waters. <br />A~hlic ('.nmmentc: Interested persons may submit written comments provided they are received by <br />the WQCD by May 6, 199h. Comments should be mailed to the Colorado Department of Public <br />Health and Environment, WQCD-PE-B2, 4300 Cherry Creek Dr. S., Denver, CO 80222-1530, or <br />hand-delivered to the WQCD. <br />Farther informafinn: Copies of relative information, including the Agreement and Stipulated Order <br />in this matter, can be obtained fora $ 0.50 per page fee by writing to the WQCD at the above <br />address. Copies of the Agreement and the original enforcement action are available by appointment <br />for public review at the WQCD at the above address.
