Y <br />• <br />Memo to MBL 5 October 3, 1998 <br />Response to FSMV Stone Gravel Pit, M-97-089 <br />issues and jurisdictional lines for Mrs. Bell. <br />Alleged County Road WOperation -During the 9/30/98 phone conversation, Mrs. Bell <br />inquired about a gravel operation located north of Dolores, near County Road W. Staff <br />replied that no such application had been assigned to him for review. However, staff <br />continued, it was possible that such application had been received by DMG and simply <br />assigned to a different staff member. Mrs. Bell inquired how she could find out whether <br />Montezuma County had submitted such application. Staff member replied that all <br />applications, received at the DMG Durango Office, are initially handled by Senior <br />Reclamation Specialist, Tom Gillis. Mr. Gillis then assigns the application to various staff <br />members. <br />Staff did not explain the details of DMG application routing for Mrs. Bell for 3 reasons: <br />1. Mrs. Bell inquired whether staff were reviewing the alleged application. Mrs. <br />Bell did not ask for a description of the permit review process. <br />2. Mrs. Bell has previously participated in DMG's permit review process and <br />appeared to be well informed in the procedure. Mrs. Bell's 11 /2/97 objection <br />to the Stone Gravel Pit application was addressed to DMG Denver Office and <br />copied to the DMG Durango Office. <br />3. DMG may receive applications at any of their offices. Procedures for <br />receiving applications at the DMG Durango Office are detailed in a 7 page <br />description. Governmental procedures and policies are often detailed and <br />complex; to volunteer such descriptions, unsolicited, is generally not <br />warranted. <br />DMG has not and will not withhold public information from the public. However, DMG <br />should not be held accountable for not answering questions which have not been asked. <br />Request for Hearing -DMG Durango Office records do not indicate that DMG has received <br />any requests, written or verbal, for public hearing or for information regarding the alleged <br />County Road W grave/ operation. However, it is possible that such requests have been <br />submitted to other agencies. <br />lend of memo) <br />
