• hereby certify that the construction of Sedimentation Pond 008 was <br />inspected and constructed under my supervision. From August G until <br />August 5, 1987 during construction, I was on site to inspect the <br />construction of this structure. The construction was supervised on site <br />by Rey Armijo, a graduate civil engineer and Operations Engineering <br />Manager at the Seneca II Mine. Rey assured all work was performed in <br />accordance with the design and the specifications. I inspected the <br />completed structure on October 8, 1987 to verify the as-built conditions. <br />I, James Gary Schlenvogt, am a 1975 graduate in civil engineering and I <br />have been a Registered Professional Engineerin Colorado since October 17, <br />1980. <br />The purpose of my inspection and certification was to ensure proper <br />construction of Sedimentation Pond 008 and to satisfy the requirements of <br />Rule 4.05.6(7) of the Colorado Mined Land Reclamation Division. The <br />material was placed in the embankment to meet or exceed the design <br />specifications. The compaction tests er.ceeded the design specifications. <br />• This as-built report confirms the construction cf this structure meets or <br />exceeds the Rules and Regulations of the Colorado Mined Land Reclamation <br />Division. The structure is stable, evidencing no indications of slope <br />instability. <br />To the best of my knowledge, based upon my professional expertise, and to <br />the extent possible, this sedimentatier~ pond at the Seneca II Mine was <br />constructed in accordance with the prudent state-of-the-art of earthen <br />embankment construction. Further, the structure was constructed in <br />compliance with the approved design, to the extent pessible, as specified <br />in Appendix 7-6e of Peabody Coal Company's approved mine permit. Minor <br />field adjustments in horizontal and vertical alignment were necessary <br />during construction to compensate for unanticipated natural conditions, to <br />achieve the necessary storage capacit}~, limit the disturbed area, and <br />construct a structure consistent with the existing and reclaimed <br />topography. <br />To the best of my knowledge and belief, field adjustments made during <br />construction to the structure are in conformance with the Pules and <br />8 <br />
