Revised May, 1984 <br />• except for underground mining which shall cover only those areas affected <br />or to be affected by surface operations and facilities, including: <br />(a) A map, prepared according to the requirements of 2.10 and <br />supporting narrative of the uses of the land existing at the time of the <br />filing of the application, in accordance with land use categories <br />established in the land use definition in 1.04. If the premising land <br />use of the land was changed within the five years prior to the date <br />operations are proposed to begin, the historic use of the land shall also <br />be described. <br />RESPONSE: <br />The land use within and adjacent to the proposed permit area is <br />• graphically presented in Map 9, Bnergy Mine No. 3 Land Use. Land <br />use within the proposed permit area, as defined in Rule 1.04<71), is <br />pastureland. The definition of "land use" specifically is given in <br />Rule 1.04 as "uses or management - related activities rather than <br />the vegetation or cover of the land". Because of the change in the <br />vegetation or cover that inadvertently occurs due to "surface coal <br />mining and reclamation operations" will not cause a change in the <br />uses or management of the land after mining, the post-mining land <br />use will remain the same as the pre-mining land use, that of <br />pastureland. Pastureland is defined under Rule 1.04(71)(b) as land <br />"actively managed for grazing, browsing or for occasional hay <br />production". The inclusion of the term "browsing" confirms the <br />• intent to not exclude from the pastureland classification, land on <br />which shrubs are a component of the plant community.
