""~' 8. It is a provision of this permit that the operations will be conducted in accordance with the tams end oonditiens
listed in your application, as well as with the provisions of the Act and the Constrtnctian Material Rules and Regutatiaas
in effect at the time the permit is issued.
9. Annually, on the anniversary date of permit issumroe, you must subarit en annual fce as spceified by Statute, and
ao annual report which includes a map describing the anxeage affected and the acreage rcelaimed to date (if there are
chances from the previous year), arty monitoring nequired by the Reclamation Plan to be submitted annually on the
saniversary date of the permit approval. Annual fees ere for the previous year a permit is held. For example, a permit
with the anniversary date of ]uly 1, 1995, the amual fce is for the perior! of ]uly I, 1994 through June 30, 1995.
Failure to submit your amoral fee and report by the permit anniversary date may result in a civil penahy, revocatia- of
your permit, and forfeiture ofyour fmanciel warranty. It is your responsibility, as the permittee, to oaCuare topayyour
annual fce to the Office until the Board releases you from your total reclamation responsibility.

A reportable spill is a spill of aoy toxic or hazardas substantce (includmg spills ofpetrokurn pnonhncts) widrinthe
mined land permit area reportable to arty Division ofthe Colorado Department of Public Health and the Envirarmau, the
National Response Cemer, the Colorado Emergency Planning Commission, any local Eoaergency Planning Caomissien,
local Emergency Plaening Committce, or the State Oil Lspcetor. The Mine Operator shall mtifythe DivisionofMinnerals
and Geology (DMG) of a reportable spill within the mined lead permit area using the same tinrefr~ame required by the
Permit, lioarse, notice, statute, rule or regulation governing the reporting of the spill to tier other appropriate agauy.
Notice of a reportable spill shall be FAXed to: Minerals Program Supervisor, Division of Minerals and Geology,
FAX [phone]. The FAX shall include a tall-back number of a respoffiibk company official for DMG stafftouse
as a contact.
