The applicant <br />continues to negotiate with various structure owners and is developing <br />engineering analyses if no agreement can be reached. The revised version of <br />the original Mining Plan Map, now subtitled "Maximum Recovery Scenario," <br />illustrates mining limits when the 200-foot setbacks across the site have been <br />resolved to allow for excavation within the statutory buffer. <br />Concluding Remarks <br />As conveyed to you by a separate letter, the applicant has waived its right to a <br />decision on August 21, 2006, the 90-day review deadline for the application. In a <br />letter dated, August 17, 2006, the applicant requested a new decision date be <br />scheduled for September 20, 2006.
