It is highly unlikely that <br />slides would occur; however, it is very likely that once the site is disturbed runoff will increase and cause <br />off site erosion and sedimentation unless erosion control features are in place. You have stated that "Best <br />Management practices of mining will be used to protect areas outside the affected land from slides and <br />other damage." Please describe the practices that will be used to prevent runoff from eroding the slopes <br />below the limit of extraction and depositing sediment from [he disturbed area outside the affected land <br />boundary. If these practices include construction of erosion control structures such as sediment traps, <br />provide typical plans and show their locations on the mining plan map if they are temporary and also on <br />[he reclamation plan map if [hey will remain after reclamation is complete. Your Exhibit E states [hat a <br />low earthen berm will be established to keep all storm water on site. Such a berm must be on the contour <br />to prevent channeling water to a low spot where overtopping would wash out that portion of the berm <br />and contribute [o erosion at that location. If the berm is actually a diversion it should not be on the <br />contour but should have some grade to the channel to divert water to a safe outlet. (see item 8 above) <br />Please describe the berm in more detail. <br />18. Rule 3.1.9(1) requires that overburden be removed and segregated from topsoil. There will most likely <br />6e no overburden other than topsoil [o be removed from Phases 2 and 3; however, [here is likely to be a <br />significant amount of overburden other than topsoil that will have [o be removed from Phase 1 prior to <br />extraction of [he gravel. Please describe your plan for segregating such overburden from topsoil. Show <br />typical topsoil and overburden stockpile locations on the mining plan map. <br />19. Rule 3.1.9(2) requires that "where practicable woody vegetation present at [he site shall be removed or <br />appropriately incorporated into the existing topsoil prior to excavation within the affected areas." Your <br />plan is [hat "trees that are [o be cut wilt be used for reclamation purposes." Describe how you will <br />incorporate the trees into the topsoil. <br />20. Your plan a[ 6.4.5 states "No less than 10 pounds of nitrogen (N) and 40 pounds of phosphate N205 per <br />acre will be applied. Please change N205 [o P205. Also, your section 3.1.9(7) states [hat about 40 tbs. <br />of available N&P is recommended. Please state whether you plan to apply 10 or 40 lbs. of N per acre. <br />21. In your Exhibit E section 3.1.12(3)(e) you mention a 10 acre floating bond. In your Exhibit E section <br />6.4.4(e) you discuss a 20 acre floating bond. Please explain [his discrepancy. <br />Exhibit L -Reclamation Cost <br />22. The Division will review this exhibit after we receive your response to this adequacy letter. <br />Exhibit S -Permanent Man-made Structures <br />23. The only structures addressed under this exhibit are fences. Please address the power line [hat crosses <br />the north portion of [he permit and affected land area. Address all the pertinent sections of this exhibit. <br />
