Date: Februazy 18, 2003 <br />To: Joe Gagliano <br />From: Larry Oehler <br />Re: File No. M-2003-I 18, D G Huskin Construction Company, Velazde Pit, Adequacy Review Items <br />The following items must be addressed by the applicant in order to satisfy the applicable requirements of C.R.S. 34- <br />32.5-101 et seq. and the Construction Materials Rules and Regulations of the Mined Land Reclamation Board. <br />General <br />1. Rule 6.2.1(2)(e) states that the acceptable range of map scales shall not be larger than Iinch = 50 feet nor <br />smaller than Iinch = 660 feet. Please provide maps in [his scale range, except for the location map. <br />Exhibit C -Pre-mining and Mining Plan Map(s) of Affected Lands <br />2. Please show on a map in [his exhibit the power line that crosses the proposed permit area and affected lands <br />azea. This is an east-west power line located near the north permit boundary, Show also the name of the <br />owner of the power line. Rule 6.4.3(a) and (g) <br />3. On a map in [his exhibit show the access haul roads to/from [he county roads as affected land. This is <br />necessary because the Division learned during the pre-operation inspection [ha[ the roads are [o be <br />significantly upgraded. (Rule 6.4.3(a) and Rule 1.1(3}) Addition of the hauUaccess roads as affected land <br />will constitute an amendment of this application. Rule 1.8 will apply. This rule at section 1.8.1(6) requires <br />that a new decision date be set pursuant to subparagraph 1.6.6, which requires that all applicable deadlines <br />shall begin anew. This rule also requires that the applicant publish and mail a new notice of [he <br />application. <br />4. Please show on your maps and on the map legend an affected land boundary. It is obvious that the <br />boundary, until the roads are added to affected land, is the outer boundary of the phases. However, the <br />boundary is not named on the maps or shown in the legend with a symbol. <br />Exhibit D -Mining Plan <br />5. Your exhibit states [hat "Concrete and or asphalt batch plants will be erected on site as needed --- <br />If the demand is sufficient to warrant, they may become permanent for the life of the mine." Since the <br />Division must make a decision to approve or deny the application based on what it contains, either show <br />the location and plans for constructing such permanent plants or delete the reference to permanent plants <br />from the application. Any such plans should include plans for containment of any potential spills of <br />petroleum products and other potential contaminants. <br />6. If the concrete and or asphalt batch plants aze portable plants, state so. If an asphalt batch plant is <br />proposed, provide your plans for containment of all petroleum products and other potential contaminants. <br />7. Your application states "Overland conveyors may also be employed during the life of this mine [o <br />transport material to [he processing areas." Please clarify this statement. Will the conveyors be portable, <br />temporary equipment setup to operate within the presently proposed phases of mining? If the conveyors <br />
