A close reading of the permit has revealed two possib:~e errors, one mirror and ORn major. The minor error is in the first line after ldI'f':.ESSI:Ti{ on the first page where it states that our company "...desires to conduct an "open" mining operation...". The Henderson P1ine is an underground mining operation. The majcr error is special condition nu;.ber 1 on ;age 2 of the permit. The condition states "...shall not allow the total disturbed acreage to • exceed 940 acres of affected land." The Timetable of Disturbance and Reclamation, Table 5.1, pages 5 - 11 of the application, indicates 940 acres of. "affected land" in 1977, approximately 876 acres in 1979, 1,077 acres by 1983, etc. Obviously, more than 940 acres will be disturbed during the course of. the operation. 1't:e "total surface acreage to be included in the permit", item 13 on the application form, indicates the "permitted area" to be 6,G27.G acres. Another point that should be noted is that we fully intend to update the bond as necessary as affected land increases due mainly to the ongoing deposition of tailing.
