The required fee of $257.00 for the renewal <br />and $257 for the amendment of this substitute supply plan have been submitted (receipt no. 3617465, <br />and 3619207). The original supply plan was approved on September 27, 2004 and the plan was <br />renewed on June 1, 2006, and March 14, 2007. <br />Plan Operation <br />The mining plan includes a slurry wall around the perimeter of the site during mining. <br />The slurry wall has been completed; however, recent tests have indicated that there is a leak in <br />the liner. 120`" Estates Partners, the owners of the 124'" is currently working to fix the slurry wall <br />and anticipates that the slurry wall liner will be fixed and approved prior to October 31, 2007. <br />Since the pit is not considered to be lined, this amendment is required to account for and replace <br />additional depletions that result from water lost in mined product during the period of May 1, <br />2007 through October 31, 2007 <br />All mining will be accomplished using a dry mining method. The plan includes a rinse <br />water lagoon and dewatering pond contained within the slurry wall with a combined exposed <br />surtace area of 2 acres. Other consumptive uses at the site include dust control and water <br />removed in product. <br />Water pumped from the dewatering pond will be discharged into the Henderson Water <br />Ski Lake ("Ski Lake"), a reclaimed and unlined gravel pit. Evaporative losses from the Ski Lake <br />are augmented under division 1 Water Court case no. 82CW393. According to the plan and <br />based on site observations of the Ski Lake, no significant increase in evaporation wilt occur from <br />
