~ • The condition. capability and productivity of the existing site <br />is poor. There is no topsoil or vegetation cover, or erosion <br />protection. There are steep gullies and embankments made up of <br />overburden and coal refuse. The diverted stream cannot handle <br />the peak flow from a 10-year 4-hour precipitation event. The <br />land should be greatly improved after reclamation. <br />The surrounding undisturbed land has a vegetation cover of <br />approximately 10-15%. This vegetation consists of native grasses <br />and pinon-juniper pygmy forest. The land use classification <br />under local law (Las Animas County Zoning Office) for the pro- <br />posed permit area and adjacent area is Highland Agriculture. <br />(See attached latter from Las Animas County Zoning Office <br />• discussing the definition of Highland Agriculture.) <br />Before mining. the land was used td graze cattle, as was stated <br />by the property owner, and because of sparse vegetation, could <br />not support much cattle.
