CEASE AND DESIST ORDER <br /> Based upon the foregoing findings of fact and notice of violation, <br /> and pursuant to the provisions of C.R.S. 1973, 34-32-123, the Board hereby <br /> orders you to: <br /> 1. Immediately cease and desist all unpermitted mining operations. <br /> 2. Submit a listing and legal. description of all unpermitted mining <br /> operations, operated by the county from July 1, 1973 Lo the present. <br /> 3. Submit a permit application to the Board for each unpermitted <br /> mining operation listed in paragraph 2 of this order. Por sand and gravel <br /> operations which were previously mined but are stlil unreclaimed, submit <br /> information required by the Board. <br /> 4. To give written notice within five (5) days after receipt of this <br /> notice to the Mined Land Reclamation Board of your compliance with paragraph <br /> one (1) of this cease and desist order. <br /> 5. To submit to the Board within ten (10) days after receipt of <br /> this order the listing required by paragraph Lwo (2) of this order and a <br /> proposed schedule of compliance to meet the requirements of paragraph three (3) <br /> of this order. <br /> 6. To cease violating Article 34 of Title 32, C.R.S. 1973, as amended, <br /> by continuing to have pits mined without permits ehich have not been reclaimed. <br /> In clarification of the rights of receipients of notices of violations, <br /> cease and desist orders, parties are advised to consult the Colorado Mined Land <br /> Reclamation Act and the State Administration Procedure Act. <br /> Nothing herein contained, particularly those portions requiring <br /> certain acts to be performed within a certain time, shall be construed as a <br /> permit or license either to violate any provisions of the Mined Land Reclamation <br /> laws and regulations promulgated thereunder or to engage in any prospecting or <br /> mining operations within the State. <br /> Persons concerned with judicial review of the provisions of this order <br /> are advised to consult C.R.S. 1973, 34-32-124 (3) , as amended (1976 Session <br /> Laws, N.B. 1065). <br /> Dated at Denver this Z� day of &AJ6' , 1978. <br /> MINED LAND RECLAMATION BOARD <br /> Department of Natural Resources <br /> BY a'�J <br />
