Determination of Amount of Performance Bond [Regulation 3.05.2(1)] <br />The Division has prepazed a preliminary estimate of the amount of performance bond sufficient to assure <br />the satisfactory reclamation of the proposed coal exploration disturbance if, in the event of bond forfeiture, <br />the work had to be performed by the Division through independent contractors. This preliminazy estimate <br />was sent to you under separate cover by facsimile transmission on September 28, 2007. The amount of <br />performance bond calculated was $9,016. This amount reflects the cost to reclaim 27 drill holes; however, <br />WFA does not presently possess the required right to enter and conduct the proposed activities for five of <br />these holes. As such, this NOI, when approved, will be for 22 boreholes. We have received an appropriate <br />bond in the amount of $9,016. <br />Adequacy Review <br />It is indicated on page 2 of the original Notice of Intent that there will be 48 exploration sites, and <br />that exploration will occur from 6/2007 to 10/2007. Please submit a revised page 2 to indicate that <br />there will now be 22 sites, and to indicate the new period of exploration. <br />2. It is indicated on page 2 of the original Notice of Intent that exploration will occur in Section 1 I of <br />T46N R16W. "Map 1", however, does not show any proposed drill holes in Section 11. Please <br />revise page 2 of the NOI to remove the "11"from this page if there will be no drilling in that <br />Section. <br />It is indicated on page 2 of the original Notice of Intent that exploration will completed by 12/2007. <br />Please revise this date if in fact drilling will need to continue into 2008. <br />4. It is stated on page 7 of the original Notice of Intent, in the pazagraph entitled "ITEM SA", that, <br />"The forty eight (48) exploration drill holes will be drilled...". Please revise this page to provide a <br />revised sentence to read "The twenty-two (22) exploration drill holes will be drilled...". <br />The First pazagraph on page 8 of the original Notice of Intent begins with "If an aquifer is <br />encountered...". Please add at the end of this paragraph the following two sentences: "In this case, <br />an aluminum cap with a hole identifier will be placed in the top of the cement to complete the hole <br />plugging procedure. If any holes fall on cultivated fields, the hole plugging procedure from the <br />New Horizon Mine (the top three feet of the hole to be filled with cuttings and topsoil) will be <br />incorporated, with the hole mazked with a metal fence post." <br />Thank you for your attention to these matters.
