Bel den n~, i (1, <br />RE: Sediment Pond Inspections <br />Coo` pF aw Su 4c~ykd Pohl <br />1 an~Drm„f0- <br />i~~ A"' <br />It has become apparent from the October 31, 1983 MLRD inspection report <br />that we will be required to conduct periodic inspections of all sediment <br />ponds at Seneca and Nucla Mines. <br />The sediment ponds at Seneca and Nucla do not qualify for formal inspec- <br />tions under the State Engineer's Office or MSHA Regulations. However, all <br />sediment ponds do appear to come under the MLRD inspection criteria. I <br />have attached a copy of the page of the Colorado Regulations which requires <br />the inspections. <br />According to these regulations the operator is required to make quarterly <br />examinations of sediment ponds and file formal reports with the MLRD. <br />In order to comply with these regulations I have made up a simple inspection <br />form similar to the old MSHA form 2000-24. I am sending you a supply of these <br />forms for each impounding structure or sediment pond at each mine. I am also <br />sending each of you a copy of the MSHA "Coal Refuse Inspection Manual" which <br />should be used as a guide for inspection of the impoundments. <br />Craig, I would request that you establish a quarterly inspection schedule for <br />Radar or yourself to inspect all sediment ponds at Seneca and Nucla. These <br />inspections should commence as soon as possible and continue quarterly unless <br />otherwise notified. It will also be your responsibility to see that the <br />original reports are forwarded to the MLRD quarterly.
