The reports are to be <br />submitted in accordance with 30 CFR 77.216-3 [Permit Application Package (PAP) page 816-44 <br />paragraph 816.45([)]. This reference requires reporting promptly [CFR 77.216-3(c)]. Rule <br />4.05.6(13) is more descriptive (and perhaps more demanding), requiring reports be submitted <br />promptly on a quarterly or annual basis, as required by the Division. During my review of the <br />PAP, I found no such requirement by the Division. The subject report was submitted on January <br />8, 2001, and received at the Division on January 10, 2001. <br />Was the pond inspected for structural weakness? Yes <br />Was the pond inspected for erosion? Yes <br />Was the pond inspected for other hazardous conditions? Yes <br />Is the report certified by a registered engineer? No <br />Is the sediment level reported? Yes <br />Is required maintenance reported? Yes (no entry) <br />Recommend [hat [he PAP be revised to identify the time period and submittal date of the reports. <br />Some PAPS require submittal of [he reports monthly, by the 30'h of the month following. The <br />Colowyo reports are due on an annual basis as pan of the Annual Hydrologic Report. If a <br />revision to the PAP is inappropriate, I suggest a letter of the Division establishing the <br />requirement (a copy filed in the PAP next to page 816-44). <br />Recommend certification of the (future) reports by a registered engineer (a registered engineer <br />cannot certify an inspection in which he did not participate). Complete certifications are <br />described in the Policy Memorandum of July 13, 1984, but I have noticed common practice in <br />the Division is to accept a PE stamp as sufficient. <br />The copy of the report I reviewed is attached.
