,• <br />PERMISSION TO ENTER, MINE AND RECLAIM <br />1/we the undersigned Owner(s) of certain real estate located in EI Paso County, <br />Colorado ("Property"), hereby grant Oglebay Norton Industrial Sands, ]ne.,.(hereinafter <br />referred to as the "Applicant/Operator'") permission to enter and initiate permitting, <br />exploration, mining acid reclamation activities on the Property described below and <br />made part of the Colorado Division of Mineral and Geology Regular 112 Mining and <br />Reclamation Permit application described below. <br />The aforementioned Property is composed of the following parcel of legally described <br />real estate and is comprised of 300 acres, more or less. <br />LEGAL ll1~.SCR[PTION: <br />A parcel of land situated in the South one half of Section 34, Township 16 South, and <br />the Northwest Quarter of Section 3, Township 17 South, all in Range 62 West of the <br />Sixth Principal Meridian, County of El Paso State of Colorado, to wit: <br />Beginning at the Northwest Corner of the said Section 3, the said point being <br />coincidental with the Southwest corner of the said Section 34; THENCE, N 90°00'00" <br />E, along the South line of the said Section 34, with all bearings contained herein relative <br />thereto, a dist~uice of 200.00 feet; THENCE, N O1°34'34" E, departing from the <br />aforesaid section line, a distance of 2509.63 feet; THENCE, N 89°48'43" E, a distance <br />of 4750.75 feet; THENCE, S 02°03'23" E, a distance of 2525.90 feet to a point on the <br />South line of the said Section 34 from whence the Southeast corner thereof bears N <br />90°00'00" E a distance of 200.00 feet; THENCE, N 90°00'00" W, along the South line <br />of the said Section 34, a distance of 4060.38 feet, to a point from whence the point of <br />beginning bears N 90°00'00" W, 1050.00 feet; THENCE, S 00°16'50" W, departing <br />from the aforesaid section line, a distance of 650.00 feet; THENCE. N 90°00'00" W, a <br />dista~rce of 650.00 feet; THENCE, S 00°16'50" W, a distance of 550.00 feet; THENCE. <br />N 90°00'00" W, a distance of 400.00 feet to a point on the West line of the Said Section <br />3 from whence the West Quarter comer thereof bears S 00°16'50" W, a distance of <br />1434.67 feet; THENCE, N 00°16'50" E, along the West line of the Northwest Quarter <br />of the said Section 3, a distance of 1200.00 feet to the Point of Beginning. <br />The said parcel contains 13,058,549 sq. ft.
