Pit IFde M-2001-015) Adequacy review of permit applieauon <br />Dear Mr Dorenkamp: <br />The Division has conducted its review of the adequacy of the permit application for the above referenced pit and has <br />identified the following concerns: <br />NOTICES: Although it is relatively early in the perntiltine process, there is nu e•~idence supplied ~•.r.ih the <br />application of the publication of the newspaper notice of the application required by Rule L6.2(I l(dl of of the notice <br />required by Rule 1.6.2(1 l(el(i) w be made to the Owner of Record of the surface and mineral rights to the af(ecteJ land. <br />Prior to any approval of the application, the Division must he supplied with proof of the regwred publication of the <br />newspaper notice and the nonce to the satiate and mineral owner of the affected land. <br />EXHIBIT BI Rule 6 3.2(c)j: The Exhibit nartative slates that there is no eYideuce of water resources which could <br />receive drainage dire.clly from the area affected by the operation. Sheet .5 of the Cuuniy Topographic Map Series fur Las <br />Animas County, however, shows a stock pcnd? a few hundred yards north of the permit area and down slope. from i1 Since <br />runoff From the pit area seems destined to flow into the natural drainage that leads to this stock pond, it would appear that <br />[his pond could receive runoff from [he affected area. <br />The County should provide a revised Exhibit B narrative that acknowledges the presence of this pond (assuming it <br />still exists). <br />L•`:HIEPI' C(Ruls 6 3.3(iii: The Exhibit narativc indicate:; tha., it uccssa:y,.iitehes, l:;,nrs an~'cr ;,onJs will be <br />constructed to control surface runoff. The Division must then take the position that it will be necessary, under some <br />circumstances', to control runoff From the area affected by the mining operation. <br />Rather than argue about just what circumstances require the installation of surface water control structures, the <br />County should simply provide a revised Exhibit C narrative that commits to install ditches, berms, and/or ponds for the <br />control of surface runoff (without the "if necessary" qualification) and a revised Exhibit E Mine Plan ntap that indicates the <br />identities and locations of these. <br />EXHIBIT E(Rule 6.3.5 (2)(c)): The Exhibit E Map, although an excellent one in most respects, does tlut show the <br />locations of any of the ditches, berms and/or ponds that may be necessary to control surface runoff from the affected area. <br />As indicated earlier in this review, the County should provide a revised Exhibit E Mine Plan Map that identifies <br />and shows the location of these control structures. <br />EXHIBIT F(RULE 6.3.6): The Exhibit narrative stales that no other permits are required; although it is common <br />for gravel mining operations that involve crushing to require an air emissions permit. <br />Please indicate that the Air Pollution Control Commission office will he contacted in reeard to the need fur such a <br />permit and indicate to the Dieision, in your response, the resuk of that contact. <br />
