ELBERT COUNTY <br />ROAD AND BRIDGE DEPARTMENT <br />809 UTE AVE. <br />SIMLA, COLORADO 80835 <br />Phone:719-541-2268 <br />Fax: 719-541-2826 <br />February 28, 2007 <br />Denver Brick Company <br />dba Acme Brick Company <br />I have received your letter proposing to operate a clay mine on property near County Road 89, <br />in Elbert County, section 19 - T9S - R61 W and in reviewing the resolution that was written in <br />October 1985, some standards have changed. <br />One being the cattle guards now need to be 20 feet in width. <br />and the other, Elbert County not foreseeing construction on this road in the next five to six years <br />Denver Brick Company will be responsible for cost of graveling and repair of said road if damage <br />occurs due to truck traffic. <br />Also, this property is now located in District # 3 commissioner area. <br />Below are the recommendations for current stipulations <br />1.) Access road entrance to pit to be placed at the top of the hill on County Road 89. <br />2.) Cattle guards on County Road 89 south of intersection 89 and State Highway 86 to be <br />upgraded or replaced to withstand the weight of the trucks and width increased to 20 feet. <br />3.) Increase mulch and planting of Ponderosa Pine seedlings as part of the reclamation plan. <br />4.) Reclamation slope to be 3 to 1. <br />5.) Sediment pond and preventative measures to prevent damage to any neighboring <br />stock ponds. <br />6.) Speed limit signs (40 m.p.h.) to be posted on County Road 89. <br />7.) Denver Brick Company to be responsible for cost of graveling and repair of said road <br />if damage occurs due to truck traffic. <br />8.)
