' Statement of Issues "Line Chip Gravel Pit" (Application #: M-2001-001) • <br />Tuesday, March 20, 2001 -Page: 4 <br />mine or to be in compliance with the regulations and laws with which the <br />plan promises to comply. Other toxic-forming substances will result <br />' from the invasion of the geological layers which, when disturbed or <br />introduced into the hydrological ecosystem, are naturally toxic forming. <br />' Therefore, the operation is a DMO and requires an environmental <br />study as well as full compliance with the laws and regulations of C.R.S. § <br />' 34-32-101, et seq. (2001. <br />' The proposed gravel pit (mining operation and reclamation <br />program) is contrary to the law and regulations of C.R.S. § 34-32.5- <br />' 101, et seq. (2001) and the application must be denied under C.R.S. <br />§ 34-32.5-115(c) (2001). The following violations of laws and <br />regulations which require a denial of the permit are by way of <br />example and not limitation. <br />1. C.R.S. ~ 34-32.5-112 (2001)(2) states: °The reclamation plan shall <br />' include provisions for, or a satisfactory explanation of, all general <br />requirements for the type of reclamation proposed to be <br />implemented by the operator. Reclamation shall be required on all <br />' the affected land. The reclamation plan shall include: <br />(b) a description of how the reclamation plan will be <br />' implemented to meet section 34-32.5-116; (which includes a <br />requirement for detailed reclamation plans for: <br />' C.R.S. § 34-32.5-116(4)(b) If earth dams are constructed to <br />impound water, the formation of such impoundments will not <br />' damage adjoining property or conflict with water pollution laws, <br />rules, or regulations of the federal government or the state of <br />Colorado or with any local government pollution ordinances. <br /> <br /> <br /> <br />1 <br />IJ <br /> <br />C.R.S. ~ 34-32.5-116(4)(c) An operator shall demonstrate <br />that all mined material disposed of within the affected area and <br />all affected areas to be reclaimed as pazt of the approved <br />application will not result in any unauthorized release of <br />pollutants to the surface drainage system. <br />C.R.S. ~ 34-32.5-116(4)(d) No unauthorized release of <br />pollutants to groundwater shall occur from any materials <br />mined, handled or disposed of within the permit area. <br />C.R.S. ~ 34-32.5-116(4)(g) Where it is necessary to remove <br />overburden to mine the construction material, topsoil shall be <br />Four States Aggregates, LLC 25 APR 2001 <br />Statement of Issues: Line Camp Pit Hearing FSA-LCP-D1-001 <br />
